These Terms and Conditions ("Terms") govern your use of the ClearPest Pest Control ("ClearPest," "we," "us," or "our") website at clearpest.site ("Site") and the submission of service requests through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms apply to website use and pre-contract inquiries only. Paid pest control services are governed by a separate written service agreement signed at the time of engagement.
1. Eligibility
You must be at least 18 years of age to use this Site or submit a service request. By using the Site you represent and warrant that you meet this requirement and that you have authority to request service at the property address you submit.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law.
- Attempt to gain unauthorized access to any portion of the Site, its servers, or related systems.
- Use automated means (bots, scrapers, crawlers) to access the Site or submit forms.
- Interfere with, disrupt, or place unreasonable load on the Site.
- Upload or transmit viruses, malware, or any other malicious code.
- Impersonate another person or misrepresent your affiliation with any person or entity.
3. Service Requests and Quotes
Requesting a free inspection or submitting the contact form does not create a service agreement. A service agreement is only formed when (a) an ClearPest technician has completed an on-site inspection, (b) we have provided a written, itemized quote, and (c) you have signed that quote or its associated service agreement.
All pricing displayed on this Site (including plan prices) is indicative for single-family homes up to 2,500 sq ft in the Austin metro service area. Final pricing depends on property size, pest type, severity, access conditions, and other factors identified during inspection.
3.1 ClearPest Guarantee
The "ClearPest Guarantee" applies to all active Shield service plans (Shield Basic, Shield Plus, and Shield Premium). If you observe target pest activity between scheduled service visits, ClearPest will return for re-treatment at no additional charge, as many times as necessary, until the pest issue is resolved. If the pest issue cannot be resolved within three additional re-service visits beyond the initial treatment, ClearPest will refund the service fee for the visit immediately preceding the unresolved issue.
Guarantee Limitations: The ClearPest Guarantee does not apply to: (a) pests outside your scheduled service plan coverage, (b) infestations resulting from failure to follow post-treatment instructions, (c) new infestations from external sources unrelated to the original treatment, or (d) services provided to non-residential properties or areas outside the Sydney metropolitan service area.
Termite Damage Warranty: Shield Premium plans include a transferable termite damage warranty up to $25,000. This warranty covers structural damage caused by termite activity within 12 months of Shield Premium enrollment, subject to proof of enrollment, active service status at time of claim, and verification by a licensed structural inspector. Coverage excludes damage from prior termite activity or infestations predating enrollment.
4. Intellectual Property
All content on the Site - including text, graphics, logos, photographs, illustrations, and blog articles - is the property of ClearPest or its licensors and is protected by United States and international copyright and trademark laws. You may view and print pages from the Site for your personal, non-commercial use, provided that you do not modify the content or remove any proprietary notices. Any other use requires our prior written permission.
The names "ClearPest," "ClearPest Guarantee," "Shield Basic," "Shield Plus," and "Shield Premium," together with related logos, are trademarks of ClearPest Pest Control.
5. Third-Party Content and Links
The Site may contain links to third-party websites (for example, for image sources or external articles). These links are provided for your convenience. ClearPest does not endorse, control, or take responsibility for the content, privacy policies, or practices of any third-party site.
6. Disclaimers
Information on the Site is provided for general informational purposes only and does not constitute professional pest control, medical, legal, or financial advice. Pest situations vary by species, climate, property, and history, and generalized guidance on the Site may not apply to your specific circumstances.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, APEXSHIELD DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
ClearPest does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, APEXSHIELD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SITE (EXCLUDING LIABILITY UNDER SIGNED SERVICE AGREEMENTS) SHALL NOT EXCEED $100 USD.
8. Indemnification
You agree to defend, indemnify, and hold harmless ClearPest and its affiliates from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from (a) your violation of these Terms, (b) your misuse of the Site, or (c) your submission of false or misleading information through the Site.
9. Governing Law and Venue
These Terms are governed by the laws of New South Wales, Australia without regard to conflict-of-laws principles. Any dispute arising under or related to these Terms shall be brought exclusively in the courts of New South Wales.
10. Termination
We may terminate or suspend your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections 4, 6, 7, 8, 9, and 12 survive termination.
11. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date. Material changes may also be announced on the Site's homepage. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
12. Miscellaneous
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and ClearPest regarding use of the Site. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision does not constitute a waiver of that provision.
